This website is operated by Malta Retailing Limited. Throughout the site, the terms “we”, “us” and “our” refer to Malta Retailing Limited. Malta Retailing Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site you agree to be bound by the following Terms of Use, including those additional Terms of Use and policies referenced herein and/or available by hyperlink. Please read these Terms of Use carefully before continuing to use our website. These Terms of Use apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current website shall also be subject to the Terms of Use. You can review the most current version of the Terms of Use at any time on this page. We reserve the right to update, change or replace any part of these Terms of Use by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

 

ONLINE STORE TERMS & CONDITIONS OF SERVICE

Geographical Region: We provide online shopping services to specified locations within Malta (excluding Gozo and Comino) including residences, offices, and yacht marinas. We reserve the right to refuse service for any reason at any time.

Minimum Age: To place an order you must be at least eighteen (18) years of age.

Registration: In order to make use of our online shopping service, you are required to register and provide a valid cred-it/debit card in your name.

Password Security: You are also responsible to ensure that your passwords remain secure and shall remain responsible for any transactions or activities that take place through the use of such password. If you discover or suspect that your password may have been compromised, you should notify us immediately by contacting our Customer Care Department at customercare@spar.com.mt.

Processing of Data: By placing an Order you agree and understand that we may collect, use, store and process your Personal Information in accordance with our Privacy Policy (https://spar.com.mt/privacy-policy/). You are responsible to ensure that the details provided by you when registering for our services are correct and complete, and to update us with any changes to such information.

Pricing: All prices are shown in Euro and are inclusive of VAT at the rate of 18% or other sales taxes applicable in Malta. Prices are subject to change without notice. Although we try to ensure all prices displayed are accurate, errors may occur. Items which are sold by weight such as fruit, vegetables, meat and poultry, will be charged according to the actual weight picked. Although it is difficult to provide you with the exact weight requested, we will always try to select as close as possible a weight to the weight ordered/requested online. In light of this, your ‘Order Total’ might vary from that seen here and a second card payment might need to be taken. In the case of replacement products, a member of staff will call you should the need arise.

Order Process: You may place an order by pressing the ‘Proceed to checkout’ button at the end of the checkout pro-cess. You will be guided through the process of placing an order by a series of simple instructions. Placing an order by pressing the ‘Proceed to checkout’ button will entail an obligation to pay. A confirmation of the order must be sent to your email address for the transaction to be deemed complete, you will also receive an email notification from the pay-ment gateway once the order charge/s have been withdrawn.

Payment: Payment is to be effected via credit/debit cards. Please ensure that the expiry date of your payment card will still be current at the anticipated dispatch date of your order. Payment shall be taken once the products are delivered and, in the event that the payment card has expired at the point of dispatch we will be unable to take payment and/or fulfil your order. For your security, the billing name and address must match the credit card or other method used for payment. We reserve the right to cancel any order that does not comply with this or with any other security criteria.

Delivery Charges: A delivery charge of Five Euros (€5.00) is applicable for orders of less than Eighty Euros (€80.00). Delivery is free with orders of Eighty Euros (€80.00) or more in value. A charge of Five Euros (€ 5) is applicable on all deliveries above ground floor level where the premises are not serviced by a lift.

Delivery Terms: Deliveries are effected daily, from Monday to Sunday, excluding certain public holidays. Delivery Slots include ‘Morning 08:00-13:00’, ‘Afternoon 13:00-16:00’ and ‘Evening 15:00-21:00’. Delivery service may also be unavailable during any stock-taking exercise undertaken by the online supermarket. Complete and accurate delivery address information must be provided. This includes not only the address that your order is going to, but also the name of its recipient. We will not be liable should your order not reach the intended recipient as a result of you supplying us with incomplete or inaccurate information.

Cancellation Policy: If for any reason you wish to cancel you order, you may do so up to 24 hours prior to delivery.

Returns Policy: Products must be returned in a saleable condition. Food items may be returned within twenty-four hours of delivery, (including Sundays and Public/National Holidays). Other items can be returned within fifteen (15) days (including Sundays and Public/National Holidays). Delivery costs will not be refunded since this is spread over the entire order. If an order consists of only one item, and such item is returned, the cost of the delivery will be refunded as well.

Your right to return an item does not apply to certain products unless these goods are faulty on delivery or otherwise infringe your rights as a consumer. Such items include: • perishable items; • goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after de-livery.

You are required to take reasonable care of items. Items must be returned in their original and undamaged packaging with all of their components. We reserve the right to consider the condition of any product that you wish to return in determining whether to accept a returned product. Receipts of purchase must be also be provided.

Refunds Policy: Should you wish to return any goods delivered to you and which may be returned in terms of these Terms and Conditions you must send back the product or personally deliver same to INTERSPAR Supermarket at Level -1, Daniel's Mall, High Street, Hamrun, Malta without undue delay and in any event not later than twenty four (24) hours of delivery of the product, in the case of food items, and fifteen (15) days of delivery in the case of other items which may be returned in terms of these Terms and Conditions. The direct costs for returning the goods shall be at your expense. Provided the product is found to be in a saleable condition, we shall either replace any damaged product by an identical one in good condition or provide you with a refund, depending on your preference.
